This website is operated by Manteau Noir. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Manteau Noir.

These Terms of Service apply to your use of our website, purchases made through our online store and participation in our email and SMS marketing programs.

By accessing our website, placing an order with us or subscribing to our marketing communications, you agree to these Terms together with any other policies referred to on our website, including our Returns, Shipping & Conditions and Privacy Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Our online store is hosted by Shopify, which provides the e-commerce platform through which we offer our products for sale.

1. USING OUR ONLINE STORE

You may use this website only for lawful purposes and in accordance with these Terms.

You must not use the website in any way that infringes the rights of another person, interferes with the operation or security of the website, introduces malicious software or attempts to gain unauthorised access to our systems.

You are responsible for ensuring that any information you provide to us when placing an order or creating an account is accurate and current.

2. PRODUCTS

We take care to describe and photograph our products as accurately as possible.

Many of the pieces we sell are made in natural fibres, handmade, hand-finished, dyed, washed or produced in small quantities. Minor variations in colour, texture, finish and dimensions may therefore occur and can form part of the individual character of the product.

Colours may also appear differently depending on your device or screen settings.

Product availability is subject to change. An item appearing on the website does not guarantee that it will remain available.

Nothing in this section limits your rights where a product fails to meet a consumer guarantee under the Australian Consumer Law.

3. PRICES

All prices displayed on our website are in Australian dollars unless otherwise stated.

Prices may change from time to time. A price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred and we contact you before fulfilling the order.

Any applicable shipping charges will be shown at checkout before you complete your purchase.

4. ORDERS

Placing an order through our website constitutes an offer to purchase the selected products.

Your order is not accepted until payment has been successfully processed and we have confirmed the order.

We may decline or cancel an order where, for example, a product is unavailable, there has been an obvious pricing or product information error, payment cannot be authorised, or we reasonably believe the order is fraudulent or intended for unauthorised resale.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order to the original payment method.

5. PAYMENT

Payment must be made using one of the payment methods offered at checkout.

You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method provided.

Payment processing may be provided by Shopify or other third-party payment providers. Their own terms and privacy practices may also apply.

6. SHIPPING & DELIVERY

Our shipping arrangements, dispatch schedule, complimentary Australian shipping threshold, Express Post options and return-shipping conditions are set out in our Returns, Shipping & Conditions policy.

Delivery timeframes are estimates only and may be affected by Australia Post, couriers, peak trading periods, weather events or other circumstances outside our reasonable control.

Nothing in this section limits any rights you may have under Australian law where goods are not supplied within a reasonable time.

7. RETURNS, REFUNDS & CONSUMER GUARANTEES

Change-of-mind returns, exchanges, store credits, sale-item conditions and return procedures are governed by our Returns, Shipping & Conditions policy.

For an approved change-of-mind return, store credit is issued as a Manteau Noir gift card in accordance with that policy.

Your rights in relation to faulty, damaged, unsafe or incorrectly supplied products are governed by the Australian Consumer Law and are not limited by our voluntary change-of-mind policy.

8. GIFT CARDS

Manteau Noir gift cards are subject to the conditions stated when the gift card is issued and to applicable Australian law.

Purchased gift cards cannot be redeemed for cash except where required by law.

Store credit issued following an approved change-of-mind return is provided as a Manteau Noir gift card in accordance with our Returns, Shipping & Conditions policy.

9. PROMOTIONS & SALE OFFERS

Promotions, discount codes and special offers may be subject to additional conditions stated at the time of the promotion.

Unless otherwise stated, promotional offers cannot be combined.

We may withdraw or amend a promotion when reasonably necessary, but this will not affect an order already accepted under the promotion.

Sale-item change-of-mind conditions are set out in our Returns, Shipping & Conditions policy.

10. SMS MARKETING TERMS & CONDITIONS

If you choose to subscribe to Manteau Noir SMS marketing, you agree to receive recurring marketing and informational text messages from Manteau Noir at the mobile telephone number you provide.

When you first subscribe, we may send you a message confirming your signup.

SMS messages may include information about new arrivals, Manteau Noir and Violetta par Manteau Noir collections, special releases, sales, events, private offers and other news from Manteau Noir.

Your consent to receive SMS marketing is voluntary and is not a condition of purchase.

Message frequency may vary depending on our marketing schedule and your interaction with Manteau Noir. Additional messages may be sent periodically based on your engagement with our marketing program.

Your usual mobile carrier message and data rates may apply. If you have questions about your mobile or data plan, please contact your mobile service provider.

Mobile carriers are not responsible for delayed or undelivered messages.

We use Mailchimp and its SMS service providers to operate our SMS marketing program.

You may unsubscribe from SMS marketing at any time by following the unsubscribe instructions contained in our messages.

Where supported, you may reply STOP to unsubscribe. Where reply-based opt-out is unavailable, including where an alphanumeric sender name is used, an alternative functional unsubscribe method such as an unsubscribe link will be provided.

After you unsubscribe, we may send one confirmation message advising that you have been unsubscribed. Marketing SMS messages will then stop unless you subsequently subscribe again.

If you would like to receive SMS messages from Manteau Noir again after unsubscribing, you may subscribe again through one of our available signup methods.
